Recent Truck Accidents in the Area
April 28, 2011 – U.S. 49 South
A person was injured when a tractor-trailer overturned near a Florence, South Carolina produce stand. After the collision, diesel fuel and smoke was seen coming out of the tractor-trailer.
Jackknifing: Truck drivers are required to reduce their speed for hazards in the roadway and for construction zones. The truck driver must maintain a safe speed and distance from other vehicles to avoid having to brake suddenly and to keep his vehicle from jackknifing. A tractor-trailer will jackknife when the trailer off-tracks and swings out in sudden braking situations, causing the vehicle to lose control and oftentimes to overturn. We have handled a number of cases involving jackknifing tractor-trailers and you can see our case results by clicking here.
South Carolina Law
Interstate trucking companies are governed by the Federal Motor Carrier Safety Regulations (“FMCSR”), including trucking operations, driver qualifications, hours of service, maintenance of equipment, insurance, and alcohol and drug testing. South Carolina also has state specific regulations governing intrastate trucking companies. Intrastate trucking companies pick up and deliver loads only in the State of South Carolina and do not cross state lines. The South Carolina Department of Public Safety is responsible for motor carrier safety and has adopted many of the federal regulations as also being applicable to intrastate trucking companies. Under South Carolina law, intrastate trucking companies must have liability coverage for personal injuries in the amount of $750,000 ($300,000 if the gross vehicle weight is less than 10,000 lbs.). The laws governing hours of service are different for intrastate drivers in South Carolina as compared to federal laws governing interstate drivers.
